Dietetic practice, like all healthcare practice, involves some legal risk. We can become so fixated on the pitfalls that we lose sight of the pleasures associated with practice. “You can never be too careful” can mean focusing so closely on “defensive dietetics” (over-documenting, reading statutes, etc.) that there isn’t enough time left to make a living in the field. You can be too careful! This module will provide tactics and information to make your job easier and safer. With time and organization, you can preserve the enthusiasm and fulfillment found in practicing dietetics, while keeping legal exposure to a manageable level.


This legal protection continuing education program will teach registered dietitians what malpractice is and how to avoid exposure to claims by describing the provision and documentation of quality care. After studying the information presented here, you will be able to:
  • Explain the concept of malpractice liability, and list five preventive steps to reduce exposure
  • Explain how the changing role of dietitians in ordering therapeutic diets impacts their liability
  • Identify the components of Nutrition Care Process (NCP) documentation recommended by the Academy of Nutrition and Dietetics
